Terms of Service

These Terms of Service ("Terms") govern your use of the Eventopia platform operated by Laraben BV (Belgium, KBO / BTW BE 0756.758.069), accessible at eventopia.be. By creating an account or using the platform, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Eventopia you confirm that you are at least 16 years old (or the age of digital consent in your country), that the information you provide is accurate, and that you accept these Terms and our Privacy Policy.

2. Platform Description & User Roles

Eventopia is a software-as-a-service platform that connects several types of users around events:

  • Organizers β€” create and manage events, sell tickets, run a bar POS.
  • Customers β€” buy tickets and top up cashless wallets.
  • Providers β€” offer services (DJs, catering, production) to organizers.
  • Venues β€” list venues for booking by organizers.
  • Agencies β€” manage multiple artists / providers.

Eventopia is a neutral platform. Contracts are concluded directly between organizers and their customers, providers, or venues. Laraben BV is a payment facilitator and a technical intermediary, not a party to those contracts, except where we expressly state otherwise.

3. Account Responsibilities

  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity under your account.
  • You must notify us immediately of any unauthorized access.
  • You agree to provide accurate and up-to-date information.

4. Tickets & Refunds

Tickets are issued by the organizer of the event. The organizer defines the refund policy per event. Unless required by mandatory consumer law, tickets are generally non-refundable and non-transferable.

  • If an event is cancelled, the organizer will process refunds through the platform.
  • If an event is rescheduled, tickets typically remain valid for the new date.
  • Customers acknowledge the Belgian "distance selling exception" (art. VI.53, 12Β° WER): tickets for leisure events are exempt from the 14-day withdrawal right.

5. Cashless Wallet & Bar POS

  • Top-ups are prepaid and can only be used for purchases at participating events.
  • Unused balances can be refunded within the refund window defined by the organizer, typically up to 14 days after the event.
  • Balances not claimed within the refund window may expire according to the organizer's published policy.
  • RFID wristbands remain the property of the organizer unless stated otherwise.

6. Provider & Venue Marketplace

Providers and venues may list their services on the platform. Organizers can send booking requests; any resulting booking is a direct agreement between the two parties. Eventopia only provides the messaging and payment infrastructure.

7. Fees & Payment

  • Ticketing: free for the first 100 tickets sold per event. From ticket 101 onward, a fee of €0.50 per ticket applies.
  • Bar POS / cashless: revenue-share tiers starting at 5% (tiered by volume). The exact percentage is shown in your organizer dashboard before activation.
  • Payment processing: Stripe / Mollie fees are passed through at cost and shown transparently.
  • All fees are exclusive of Belgian VAT where applicable.

8. Intellectual Property

All Eventopia software, branding, and design elements are the intellectual property of Laraben BV. You receive a non-exclusive, non-transferable right to use the platform for its intended purpose. You retain ownership of the content you upload (event images, descriptions, profile data) and grant Eventopia a license to display, host and process it solely as necessary to operate the service.

9. Prohibited Conduct

You agree not to:

  • Use the platform to promote illegal goods, services, or events.
  • Circumvent ticket limits, engage in scalping, or manipulate pricing.
  • Upload malicious code, attempt to reverse-engineer the platform, or bypass access controls.
  • Harass, defame, or mislead other users.
  • Use the platform in a way that infringes the rights of third parties.

We may suspend or terminate accounts that violate these rules.

10. Limitation of Liability

To the maximum extent permitted by Belgian law, Laraben BV's liability under these Terms is limited to the fees paid by the user in the 12 months preceding the event giving rise to the claim. We are not liable for indirect damages, loss of profit, or loss of data. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or damage to life or health.

11. Governing Law & Jurisdiction

These Terms are governed by Belgian law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Brussels, without prejudice to mandatory consumer-protection rules that grant consumers the right to bring proceedings in their country of residence.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified at least 30 days in advance via email or an in-platform notice. Continued use of the platform after changes take effect constitutes acceptance of the new Terms.
